New Media Technologies, Inc. ("we" or "NWM") operates winningsurvey.org as a lead generator and matching service, with its principal office at 1207 Delaware Ave #4471, Wilmington, DE 19806. We receive a fee from our marketing partners and survey-panel partners ("Survey Partners") for matching your inquiry with them. We do not charge you a fee for our services.
NWM is an advertising and matching service. We do not operate survey panels, conduct market-research studies, or pay users for survey completions ourselves. When you submit your information through our Sites, we share that information with Survey Partners who may offer you paid survey opportunities, rewards programs, market-research studies, and related promotions. Please review our Privacy Policy, which is a part of these Terms. You hereby consent to be contacted by the Survey Partners who respond to your inquiry by email, and (where you provide a phone number and consent) by phone (including cell phone), mail, fax, or text messages at the addresses, phone number(s), and email address(es) provided by you, even if you are on the national Do Not Call list or other similar state lists.
We do not endorse or recommend the products or services of any particular third party. NWM is not a survey panel, market-research firm, employer, staffing agency, or government agency. We do not offer paid surveys directly, do not employ you, and have no responsibility for any opportunity, offer, payment, reward, or service you may obtain from the Survey Partners who receive your information. Any transaction or arrangement is solely between you and them.
The Survey Partner determines what surveys or offers you may qualify for and the terms of any payment or reward. There is no guarantee that, by submitting your information, you will be contacted by any Survey Partner, will qualify for any survey, will complete any survey, or will receive any payment or reward.
Earnings are not guaranteed. Any references on our Sites or in our advertising to per-survey payouts (including, without limitation, "$5–$75 per survey"), top-end payouts, member earnings, or the number of "members paid" reflect the best-case or high-end opportunities that may be available through Survey Partners and are not typical. Most users earn materially less than any top-end figure and some users may earn nothing at all. Your actual results will depend entirely on factors outside our control, including your demographic profile, Survey Partners' qualification criteria, survey availability, the time you invest, the completeness and truthfulness of your responses, your geography, and each Survey Partner's independent payment terms.
Paid survey participation is not employment and is not a substitute for a job. It is an irregular, opt-in opportunity offered by independent third parties. Nothing on our Sites should be construed as a promise, guarantee, or representation of any specific income, earnings, rewards, or results.
You represent and warrant that any information that you provide is truthful, accurate, current, and pertains to you; that you are the subscriber for any email address and (if provided) telephone number that you provide; and that you are a United States resident 18 years of age or older. If your email, phone number, or other information changes, you must notify us promptly at privacy@winningsurvey.org. You further agree that you will not use automated means, bots, duplicate accounts, or false identities to interact with our Sites or any Survey Partner.
You agree not to: (i) submit false, misleading, or inaccurate information; (ii) impersonate another person; (iii) use the Sites for any unlawful purpose; (iv) interfere with or disrupt the Sites or servers; (v) attempt to gain unauthorized access to any portion of the Sites; or (vi) use any automated means (including bots, scrapers, or survey-completion software) to interact with the Sites or any Survey Partner.
You will defend, indemnify, and hold us, our Survey Partners, and our respective affiliates, vendors, service providers, officers, directors, owners, employees, contractors, and agents harmless from and against any and all claims, demands, actions, losses, damages, fines, penalties, and costs (including reasonable attorneys' fees) arising out of or related to (i) any breach of these Terms by you; (ii) your violation of any applicable law; (iii) your negligence or willful misconduct; or (iv) your use of the website or services.
WE PROVIDE THIS SERVICE "AS-IS" WITHOUT WARRANTY. NWM DISCLAIMS ANY WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, AS TO ANY MATTER WHATSOEVER RELATING TO THIS WEBSITE, OUR SERVICES, OR ANY INFORMATION, PRODUCTS, SURVEYS, REWARDS, PAYMENTS, AND SERVICES PROVIDED IN CONNECTION WITH YOUR USE OF THIS WEBSITE, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT.
YOU AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY LAW, NWM AND ITS AFFILIATES, MEMBERS, OFFICERS AND DIRECTORS ARE NOT LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR CONNECTED WITH THIS WEBSITE AND/OR OUR SERVICES, INCLUDING ANY LOSS OF EXPECTED EARNINGS OR REWARDS, WHETHER RESULTING FROM BREACH OF CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE. TO THE EXTENT THESE LIMITATIONS ARE NOT ENFORCEABLE, NWM'S AGGREGATE LIABILITY SHALL NOT EXCEED US$100 (ONE HUNDRED DOLLARS).
We may modify or terminate this website, our services, or these Terms at any time. Revised terms will be posted on this website and will apply to any use after the posting date. Your continued use means you agree to the revised Terms.
These Terms are governed by the laws of the State of California, excluding its conflict of laws principles.
EXCEPT WHERE PROHIBITED BY LAW, ALL CLAIMS, DISPUTES OR CONTROVERSIES BETWEEN YOU AND US ARISING OUT OF OR RELATING TO THE USE OF THIS WEBSITE, SERVICES, CONSENTS YOU HAVE PROVIDED, OR ANY COMMUNICATION TO YOU RESULTING FROM YOUR USE OF THIS WEBSITE, SHALL BE SETTLED BY BINDING ARBITRATION GOVERNED BY THE COMMERCIAL DISPUTE RESOLUTION PROCEDURES AND SUPPLEMENTARY PROCEDURES FOR CONSUMER RELATED DISPUTES OF THE AMERICAN ARBITRATION ASSOCIATION ("AAA"). THE ARBITRATION WILL TAKE PLACE IN CALIFORNIA OR TELEPHONICALLY IF THE CLAIM DOES NOT EXCEED $2,500. TO THE FULLEST EXTENT PERMITTED BY LAW, NO ARBITRATION SHALL BE JOINED TO AN ARBITRATION INVOLVING ANY OTHER PARTY SUBJECT TO THESE TERMS, WHETHER THROUGH CLASS PROCEEDINGS OR OTHERWISE.
By using NWM's website or services and submitting online requests, you consent to these restrictions. In fulfilling a request to contact a consumer through our website, Survey Partners are third-party beneficiaries of these Terms as it relates to your representations and warranties and the arbitration provision.
